Beta User Agreement
Smoke Signal Intelligence LLC · Effective September 23, 2026
This Beta User Agreement applies to participation in the beta, pilot, early-access, preview, or testing program for AI Restoration Estimator, provided by Smoke Signal Intelligence LLC.
This Beta Agreement supplements the AI Restoration Estimator Terms of Service and Privacy Policy. By joining or using the Beta Service, you agree to this Beta Agreement.
1. PURPOSE OF THE BETA
The Beta Service is being made available to selected users so that Smoke Signal can test the platform in real restoration workflows; identify errors and usability issues; evaluate estimating functionality; improve the user experience; test workflows and business rules; evaluate performance and reliability; and collect feedback before broader commercial release. The Beta Service is still under development.
2. BETA SOFTWARE MAY CONTAIN ERRORS
You acknowledge that beta software may contain bugs; produce incorrect calculations; produce incorrect AI- generated output; misinterpret dictated or typed information; omit scope items; duplicate scope items; apply an incorrect rule; use an incorrect quantity; produce inaccurate pricing; fail to save information; change without notice; experience interruptions; have incomplete functionality; or behave differently after an update. You agree not to assume that an output is correct merely because it was generated by the Beta Service.
3. REQUIRED HUMAN REVIEW
The Beta Service is designed to assist restoration professionals, not replace them. All scopes, budgets, estimates, quantities, recommendations, calculations, and exports generated through the Beta Service must be reviewed by a qualified person before being relied upon. You are responsible for verifying scope; measurements; quantities; materials; labor; prices; subcontractor costs; allowances; building conditions; building-code requirements; insurance requirements; overhead and profit; project- specific requirements; and final estimate accuracy.
4. USE ON REAL PROJECTS
You may use the Beta Service on real projects if permitted by your organization. However, you agree that the Beta Service will not be the sole basis for a material construction, financial, insurance, contractual, purchasing, or safety decision. Any estimate or scope used on a real project must receive appropriate human review before submission or execution.
5. NO GUARANTEE OF INSURANCE ACCEPTANCE
Smoke Signal does not guarantee that an insurance company, adjuster, customer, contractor, consultant, or other person will accept a scope, line item, price, supplement, quantity, estimate, supporting documentation, or any other Beta Service output. You remain responsible for any estimate or claim you submit.
6. FEEDBACK
Beta users are encouraged to provide feedback concerning incorrect results, missing functionality, workflow problems, user-interface problems, estimating errors, feature requests, suggestions, and other observations. You grant Smoke Signal permission to use feedback without restriction or compensation to develop, improve, commercialize, and support the Service.
Your feedback does not give Smoke Signal ownership of your underlying Project Data.
7. PRODUCT CHANGES
During the beta period, Smoke Signal may add features; remove features; modify features; change workflows; change calculations; change pricing methodologies; update business rules; reset test functionality; limit access; suspend features; or discontinue the Beta Service. Functionality available during beta is not guaranteed to appear in the final commercial product.
8. PROJECT DATA
You retain your rights in Project Data you submit to the Beta Service. Project Data may include customer information; property information; measurements; scopes; photos; audio; documents; estimates; pricing; company rules; and other project information. Smoke Signal may process Project Data as necessary to operate, troubleshoot, secure, evaluate, support, and improve the Beta Service, subject to our Privacy Policy and any applicable written agreement. You represent that you have authority to provide the information you submit.
9. TESTING AND DIAGNOSTICS
Because this is a beta program, Smoke Signal may collect and review additional diagnostic information relating to errors; failed processes; feature usage; AI responses; user corrections; accepted or rejected recommendations; system performance; and workflow behavior. This information helps identify problems and improve the Service. We will handle personal information in accordance with our Privacy Policy.
10. CONFIDENTIAL CUSTOMER INFORMATION
Do not submit information that you are prohibited from providing to a third-party software service. You are responsible for complying with obligations you owe to customers; property owners; insurance carriers; employers; vendors; subcontractors; and other third parties.
11. CONFIDENTIALITY OF NONPUBLIC BETA FEATURES
Smoke Signal may identify certain Beta Service information as confidential. If we specifically identify information as confidential, you agree not to publicly disclose that information without our permission. Unless otherwise communicated, users may discuss their general experience with the Beta Service.
12. INTELLECTUAL PROPERTY
Smoke Signal owns the Beta Service and its underlying software, workflows, interfaces, proprietary systems, documentation, and technology. Participation in the beta does not grant you ownership of the platform. You retain your rights in your own Project Data.
13. NO RELIANCE ON FUTURE FEATURES
Statements concerning planned features, integrations, pricing, availability, third-party integrations, or future functionality are informational only. Product plans may change. You should not make purchasing, staffing, contractual, or other business decisions based solely on an expectation that a future feature will be released.
14. THIRD-PARTY INTEGRATIONS
Beta functionality may interact with or prepare information for third-party services. Unless expressly stated otherwise, Smoke Signal is not affiliated with or endorsed by those third parties. Third-party services may change their technology, requirements, APIs, pricing, availability, or terms at any time.
15. AVAILABILITY AND DATA LOSS
Because the Beta Service is under development, uninterrupted access and preservation of all data cannot be guaranteed. You should maintain independent copies of important estimates, scopes, customer records, project documents, contracts, insurance submissions, and other records required for your business. The Beta Service should not be the sole repository for critical records.
16. BETA SERVICE PROVIDED “AS IS”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BETA SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SMOKE SIGNAL DISCLAIMS WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THE BETA SERVICE.
17. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMOKE SIGNAL INTELLIGENCE LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE BETA SERVICE.
This includes damages arising from incorrect estimates; missed scope; incorrect pricing; project losses; material orders; insurance disputes; lost profits; lost revenue; project delays; lost data; or reliance on automated output.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE BETA SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE BETA SERVICE DURING THE PREVIOUS TWELVE MONTHS OR $100.
18. BETA ACCESS
Smoke Signal may suspend or end beta participation at any time. You may stop participating at any time. Ending beta participation does not eliminate provisions that by their nature should survive termination.
19. COMMERCIAL RELEASE
Participation in the beta does not guarantee free access to the commercial Service; a particular subscription price; permanent access to beta functionality; continued availability of any feature; or any ownership or financial interest in Smoke Signal or the Service. If a paid version is released, continued use may require a paid subscription and acceptance of updated terms.
20. RELATIONSHIP TO OTHER AGREEMENTS
This Beta Agreement supplements the AI Restoration Estimator Terms of Service and Privacy Policy. If a separately negotiated enterprise agreement applies to your organization and conflicts with this Beta Agreement, the separately negotiated written agreement controls to the extent of the conflict.
21. GOVERNING LAW
This Beta Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of- laws principles.
22. ACKNOWLEDGMENT
By accepting this Beta Agreement, you acknowledge that AI Restoration Estimator is beta software and may make mistakes. You understand that artificial intelligence and automated estimating outputs require human review. You accept responsibility for reviewing and approving any scope, estimate, budget, quantity, price, or other output before relying upon or submitting it.
